My name is Melanie Thorley and I am the principle solicitor of MJT Law.
Today I want to talk about number 7 of the 10 national employment standards.
Long service leave is by the state or territory government.
In Queensland you are entitled to get a pro-rata pay out of long service leave under certain situations and you are entitled to use your long service leave after 10 years.
There is still discussion around whether an employer and employee can come to an agreement to cash out some or all of the long service leave entitlements where an Award or Enterprise agreement does not stipulate you can.
For those employees who are eligible, portable long service leave may also apply.
Long service leave can also apply to casual employees who have worked for an employer for the requisite time.
