My name is Melanie Thorley and I am a solicitor at MJT Law. Today we are going to talk about timeframes for filing in either the Fair Work Commission or the Anti-discrimination commission of Queensland.
- 21 calendar days from the date of dismissal
- Dismissal dispute 21 calendar days from the date of dismissal
- Non-Dismissal dispute 6 years from the date the action arises
- 1 year from the discriminating event happening
HOW TO CALCULATE THE DAYS
If you were dismissed on 26 February 2019 then 21 days is 19 March 2019.
This means that if you want to make an application that is in time you must file by 11:59pm 19 March 2019.
We do not recommend that you wait until the last minute just in case you need to call the Commission you are filing in to confirm something.
